For residential development, the updated version of the B107™-2020, the standard form of the agreement between the developer-builder and the architect for prototypes of one or two single-family home projects with limited architectural services, includes an updated language of the B101, owner/architect agreement. The B107 was specifically designed to allow a developer to hire an architect to design prototype homes, the design of which can be used repeatedly by the developer. The architect should develop the design of each prototype to the minimum level required to obtain a building permit. In the meantime, it is expected that the developer will be a unit familiar with housing construction, which can then take this “permit set” of drawings and complete the project. The AEOI`s contractual documents are the nearly 200 forms and contracts that define the relationships and conditions of planning and construction projects. The documents, created by the AEOI by consensus of owners, contractors, lawyers, architects, engineers and others, have been refined throughout its 132-year history. As a result, these contracts and complete forms are now widely recognized as the industry standard. The AEOI contractual documents used by all industry professionals, including architects, contractors, owners, consultants and lawyers, are divided into two categories: by families, depending on the types of projects or delivery methods of specific projects, and by series, depending on the parties to the agreement or use of the form.

AEOI document A105™–2017 is a stand-alone agreement with its own terms and conditions. The AEOI document A105-2017 is intended for a small and short-term project, where the payment to the contractor is based on a fixed amount (fixed price). The A105-2017 replaces the A105-2007 document, a typical form of agreement between the owner and the contractor for a residential or small business project.

For larger and more complex projects, other AEOI owner/contractor agreements are more appropriate. EAR documents A105-2017 and B105™-2017, the standard short form of the owner-architect agreement, include the Small Projects family of documents. Although A105 and B105 have some similarities with other agreements, the “Small Projects” family should NOT be used with agreements in other document families without a careful comparison of the content. Although the contracts of the owner-contractor, A-Series, often seem relatively short because most of them contain more than 40 pages of terms and conditions, their length is misleading. The AEOI has a long form of terms and conditions, the A201, which sets out the rights, obligations and relationships of the owner, contractor and architect. WASHINGTON, October 20, 2020 – The American Institute of Architects (AIA) today released updated contract documents, including two major housing contracts and a free condominium project guide. The revised housing contract documents address insurance requirements, post-occupancy site visits, and maintenance requirements. The updated standard version of standard B109™-2020 of the agreement between the owner and the architect for an apartment building or a mixed-use residential project now includes a new optional limitation of liability. While aspects of the new B109 are included, the Free Condominium Project Guide includes model language related to homeowners` association, individual owners, bylaws and purchase agreements. The updated A305 allows contractors to express additional features such as safety protocols and plans, sustainability services, and the BIM experience.

The A305 can now also be fitted in a modular way. Today, the AEOI has nearly 200 forms and contracts used in the construction industry, and they are usually updated every ten years. Although these formal contracts are common in commercial construction, they are less common in residential construction and small projects. Like the A104, the A105 is a stand-alone agreement that contains its own terms and conditions. If the AIA A105 is used, the B105 is the corresponding agreement between the owner and the architect. “While the B109 is designed for multi-family housing projects, it specifically includes a statement from the owner that the project will not include a residential complex,” said James R.
